First, it's essential to understand that there are two types of titles: new style titles (issued after September 2010) and old style titles (issued before September 2010). If you're not sure which type of title you're dealing with, don't worry – we'll cover both scenarios below.

Notarizing New Style Titles

New style titles have a space specifically designed for the new seal/stamp units that make it easier to use. Notaries can place their seals in the lien holder section, just to the left of the signature in the notarial block on the title form. Remember to specify whose signature was notarized by including a phrase such as 'Signed and sworn before me by John Doe (only)'.

Notarizing Old Style Titles

For old style titles, notaries can place their seals in the lien holder section, just to the left of the signature in the notarial block on the title form. However, be aware that some older forms may not accurately contain all the information required in a proper notarial block.

Important Reminders for Notarizing Montana Titles

When notarizing a Montana title, it's crucial to include the location where the notarization was performed: 'State of Montana, County of _'. You must also ensure that all nine elements of a proper notarial block are included. This includes the date, your name and title as notary public, your commission expiration date, and the signature and printed name of each person whose signature you're notarizing.

If an error is made by the signers or the notary, a Statement of Fact will need to be completed and filed with the Title. The Montana Motor Vehicle Division will not accept a title with information that has been corrected or crossed out.

When there are two or more owners listed on a title, they do not have to have their signatures notarized at the same time or by the same notary. However, both owners must be notarized separately.
